The overtime threshold is based on a workweek, not a day or a pay period. An employer cannot average two weeks together to avoid paying overtime. Salaried employees earning less than $684 per week are automatically non-exempt and entitled to overtime regardless of their job duties.
State Overtime Rules That Are Stricter
California, Alaska, and Nevada all have daily overtime rules that are stricter than federal law. California requires 1.5× pay for hours worked beyond 8 in a single day and double pay for hours beyond 12 in a day. Alaska and Nevada require daily overtime after 8 hours. In these states, workers can earn overtime even if they did not exceed 40 hours in the week because a single long day triggers it. Where state law is more generous than federal law, state law applies.
